Robert Whaley Facing New Charges

Robert Whaley, the 6-10, 250 pound power forward from Barton County Community College (Kansas), may not end up at Cincinnati after all. Whaley signed a National Letter of Intent in November 2002 with the Conference USA school but is now facing aggravated battery charges.
UC spokesman Tom Hathaway issued a statement that said: "Anyone charged with a felony is suspended from all activity in his or her sport until the charges have gone through the legal process. ... Anyone convicted of a felony charge is permanently dismissed from the program."

Whaley was charged on Tuesday in connection with a February 9, 2003 incident. Gary Vaughan, Barton County undersheriff, told Cincinnati Enquirer reporter Bill Koch, "We had a couple of people from Garden City Community College who were assaulted after a dance. Mr. Whaley was identified as one of the people doing the assaulting. We may have other arrests coming."
Whaley ended up at Barton County after recruiting during his senior high school year was derailed. He has been charged with sexual assault with a 13-year old girl. His trial in Berrien County, Michigan ended in a mistrial and the prosecutor decided not to retry the case.
He had signed with Missouri but was released following the June 2, 2001 court order.
